2. [ Authorization. Releasor waives any claim for compensation for bodily, fatal or material damages whose children, heirs, executors, recipients of the assignment, parents, personal representatives or estates of Releaseor or which may subsequently result from participation in the activity, and exempts them forever.] Car rental companies often have drivers sign a compensation agreement before driving the car off the property. The aim is to protect against complaints in the event of an accident by the driver in the rental car. An authorization removes a claim or remedy and is an absolute obstacle to any legal action in the declassified case. See Dresser Indus., Inc. v. City of Houston, 846 S.W.2d 854, 858 (Tex. App. 1992). In case of skydiving, these are the parties involved in a compensation agreement: before moving into a rented property, a lessor can ask the tenant to sign a compensation clause in the rental agreement. This would protect the landlord from loss or damage that the tenant might cause to the property. Many cases are settled because of the costs associated with the trial and the inherent unpredictability of a jury during mediation. Mediation is a widespread alternative dispute resolution procedure used by policyholders to obtain insurance benefits from their carriers. During mediation, the parties often agree on a transaction amount in exchange for a release of the rights of the insurance policy.
